1. INTRODUCTION: Welcome to our application (the “App”). This App is published by or on behalf of Panasonic Life Solutions India Private Limited (“PI” or “We” or “Us”).

By downloading or otherwise accessing the App you agree to be bound by the following terms and conditions (“Terms“). If you have any queries about the App or these Terms, you can contact Us by any of the means set out in paragraph 13 of these Terms. If you do not agree with these Terms, you should stop using the App immediately.

2. GENERAL TERMS: This App is made available for your own, personal use. The App must not be used for any commercial purpose whatsoever or for any illegal or unauthorised purpose. You may not rent, lease, lend, sell, transfer redistribute, or sublicense the App and, if you sell your Android Device to a third party, you must reset device to factory default or remove the Licensed Application from your Android Device before doing so. When you use the App you must comply with all applicable Indian laws and with any applicable international laws, including the local laws in your country of residence (together referred to as “Applicable Laws”).

You need to sign up for this application before you start using benefits of this Application. You are advised not to use this Service (defined in below) in a way other than intended personal use on your personal device, as communicated by Panasonic. In the event of misuse, misconduct or non-compliance Panasonic has right to suspend or stop services to you. You agree that when using the App you will comply with all Applicable Laws and these Terms. In particular, but without limitation, you agree not to:

• a) Use the App in any unlawful manner or in a manner which promotes or encourages illegal activity including (without limitation) copyright infringement; or
• b) Attempt to gain unauthorised access to the App or any networks, servers or computer systems connected to the App; or
• c) Modify, adapt, translate or reverse engineer any part of the App or re-format or frame any portion of the pages comprising the App, save to the extent expressly permitted by these Terms or by law.

You agree to indemnify PI and its group companies in full and on demand from and against any loss, damage, costs or expenses which they suffer or incur directly or indirectly as a result of your use of the App otherwise than in accordance with these Terms or Applicable Laws.

3. CONTENT: The copyright in all material contained on, in, or available through the App including all information, data, text, music, sound, photographs, graphics and video messages, the selection and arrangement thereof, and all source code, software compilations and other material (“Material“) is owned by or licensed to PI or its group companies. All rights are reserved. You can view, print or download extracts of the Material for your own personal use but you cannot otherwise copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit, disseminate in any form whatsoever or use the Material without PI’s express permission.

The trademarks, service marks, and logos (“Trade Marks“) contained on or in the App are owned by PI or its group companies or third party partners of PI. You cannot use, copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit or disseminate the Trade Marks without the prior written consent of PI or the relevant group company or the relevant third party partner of PI.

4. Certain services may display, include or make available content, data, information, applications or materials from third parties ("Third Party Materials") or provide links to certain third party web sites. By using the App, you acknowledge and agree that the PI is not responsible for examining or evaluating the content, accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect of such Third Party Materials or web sites. PI, and its officers, affiliates and subsidiaries do not warrant or endorse and do not assume and will not have any liability or responsibility to you or any other person for any third-party Services, Third Party Materials or web sites, or for any other materials, products, or services of third parties. Third Party Materials and links to other web sites are provided solely as a convenience to you.

5. CHARGES: You may be charged by your service provider for downloading and/or accessing the App on your mobile phone, tablet or other handheld device (the Device). These may include data roaming charges if you do this outside your home territory. All these charges are solely your responsibility. If you do not pay the bills for your Device then we assume that you have the permission from the person that does before incurring any of these charges. We will not charge a separate fee for accessing the App, but you may be charged fees for using the services of the App (“Service Fees”). The Service Fees have already been informed to you and you hereby acknowledge the knowledge of the same.

6. COMPATIBLE DEVICES: The App will only work on compatible Devices and operating systems and certain functionality will only work if your Device is connected to the internet. Some features may also only be available with certain operating systems.

7. ACCESS AND USE OF PERSONAL AND UPLOADED INFORMATION: Your personal information is processed under Applicable Laws PI shall use your personal information in accordance with the terms of our internal policies. By using the App you acknowledge and agree that you have read and accept these Terms.

PI will do its best to ensure that transactions and information, as stored on the App remain secure and confidential. PI makes no warranty or representation of any kind in relation to the system and the network or their function or performance or for any loss or damage whenever and howsoever suffered or incurred by you or by any person resulting from or in connection with the use of the App.

The collection, verification, audit and maintenance of correct and updated information as required under the App, is a continuous process and PI reserves the right, at any time, to take steps necessary to ensure compliance with all relevant and applicable KYC requirements under the PI policy. You must ensure that the uploaded information, security details, and account information and all other information that you provide to us via the App or otherwise is complete, accurate and up to date. You shall indemnify us (and you shall keep us indemnified) and hold us and our directors, employees, agents and representatives harmless against any claim, loss, expense, liability or damages suffered by us resulting from your lapse in providing or uploading incomplete or inaccurate information in the App, and/or for any breach in your obligations set out in the Terms.

8. INTELLECTUAL PROPERTY RIGHTS: The App and all copyright, database rights, Trademarks and other intellectual property rights related to it belong to us or our licensors.

9. DISCLAIMER / LIABILITY: YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE APP IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY, AND EFFORT IS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND PI HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE APP AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS. PI DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF THE APP, THAT THE FUNCTIONS CONTAINED IN OR SERVICES PERFORMED OR PROVIDED BY THE APP WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE APP WILL BE CORRECTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY PI OR ITS AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE APP PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION.

10. Limitation of Liability. TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL PI BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APP, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF PI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. PI's total liability to you for all damages hereunder (other than as may be required by applicable law in cases involving personal injury) shall be nil. The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

11. TERMINATION AND SUSPENSION: We may terminate or suspend your use of the App with or without notice at any time and without any liability to you. Upon any termination your right to use the App, and any other rights or permissions granted to you in these Terms will end and you must stop using the App and delete it from your Device.

12. OTHER TERMS:

• a) PI reserves the right to update these Terms from time to time. If it does so, the updated version will be effective immediately, and the current Terms are available through a link in the App to this page. You are responsible for regularly reviewing these Terms so that you are aware of any changes to them and you will be bound by the new policy upon your continued use of the App. No other variation to these Terms shall be effective unless in writing and signed by an authorised representative on behalf of PI.
• b) These Terms shall be governed by and construed in accordance with Indian law and you agree to submit to the exclusive jurisdiction of the Courts at Delhi.
• c) If any provision(s) of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties (as reflected in the provision(s)) and all other provisions shall remain in full force and effect.
• d) PI’s failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by PI in writing.

Information We Collect POIS Plus receives or collects information when we operate and provide our Services, including when you install, access, or use our Services.

Information You Provide Your Account Information. You provide your SAP Code to create a POIS Plus account. This account is created to sync your offline data. This will facilitate you to browse latest data locally with out any internet connection.

Your Connections. To help you in single sign on functionality we get your account information. Customer Support. You may provide us with information related to your use of our Services, including copies of your messages, and how to contact you so we can provide you customer support. For example, you may send us an email with information relating to our app performance or other issues.

Usage and Log Information. We collect service-related, diagnostic, and performance information. This includes information about log files, and diagnostic, crash, website, and performance logs and reports.

Device and Connection Information. We collect device-specific information when you install, access, or use our Services. This includes information such as hardware model, operating system information, browser information, IP address, mobile network for diagnostics and troubleshooting purposes such as if you are having trouble with our app’s location features. Read your phone state. We read your phone state to be authenticate you that only our trade partners are connecting with us.
